Terms of Service for Manifest It

1. Acceptance of Terms

By downloading, installing, or using the Manifest It mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Manifest It is a personal development and goal-setting application designed to help users:

  • Create and track personal goals
  • Practice daily affirmations
  • Build vision boards
  • Track daily manifestation activities
  • Use scripting techniques for goal achievement

The App provides both free and premium features accessible through in-app purchases.

3. User Accounts and Authentication

To use certain features of the App, you must create an account using Firebase Authentication. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

4. Subscription and Payments

4.1 Pro Features

Certain features of the App require a paid subscription ("Pro" features). These may include:

  • Unlimited goal creation
  • AI-powered content generation
  • Text-to-speech narration
  • Image generation for vision boards
  • Advanced scripting modes
  • Unlimited API usage

4.2 Billing

Subscriptions are managed through the Apple App Store or Google Play Store, depending on your device. All payments are processed by Apple or Google, and their respective terms and refund policies apply.

4.3 Free Trial

We may offer free trials for Pro features. If you do not cancel before the trial period ends, you will be charged for the subscription.

4.4 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation will take effect at the end of the current billing period.

5. User Content and Data

5.1 Your Content

You retain all rights to the content you create in the App (goals, affirmations, vision boards, scripts, etc.). By using the App, you grant us a limited license to store and process this content solely for the purpose of providing the App's services.

5.2 Local Storage

Your personal content is stored locally on your device. We are not responsible for data loss due to device failure, app uninstallation, or other circumstances beyond our control.

5.3 Cloud Services

If you use Pro features that involve cloud services (AI generation, text-to-speech), your inputs may be temporarily processed by third-party AI services. We do not permanently store this data on our servers.

6. AI-Generated Content

The App uses artificial intelligence to generate suggestions, images, and audio content. You acknowledge that:

  • AI-generated content is provided as-is and may contain errors or inaccuracies
  • We do not guarantee the quality, appropriateness, or accuracy of AI-generated content
  • You are responsible for reviewing and editing any AI-generated content before use
  • AI-generated content should not be considered professional advice

7. Acceptable Use Policy

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to reverse engineer, decompile, or hack the App
  • Use the App to harass, abuse, or harm others
  • Share your account credentials with others
  • Attempt to bypass payment systems or access Pro features without payment
  • Use automated systems (bots) to access the App
  • Create excessive API requests that could impact service availability

8. API Usage Limits

To ensure fair usage and service availability, we implement daily API usage limits for free users. Pro subscribers receive unlimited access. We reserve the right to modify these limits at any time.

9. Intellectual Property

The App, including its design, code, graphics, and functionality, is owned by us and protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works based on the App.

10. Third-Party Services

The App integrates with third-party services including:

  • Firebase: For authentication and data storage
  • OpenAI/Anthropic: For AI content generation
  • RevenueCat: For subscription management
  • PostHog: For analytics and feature flags

Your use of these services is also subject to their respective terms of service.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • AI-generated content will meet your expectations

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of your data
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or other harmful code
  • Any errors or omissions in any content
  • Any loss of data stored locally on your device

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you create using the App

14. Modifications to the Service

We reserve the right to:

  • Modify, suspend, or discontinue the App (or any part of it) at any time
  • Change pricing for Pro features with reasonable notice
  • Update these Terms at any time
  • Implement new features or remove existing features

We will notify you of significant changes via the App or email when possible.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abusive behavior toward other users or our team
  • Excessive API usage that impacts service availability

Upon termination, your right to use the App will immediately cease. You may delete your account at any time by uninstalling the App or contacting us.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California.

17. Children's Use

The App is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us.

18. Medical and Professional Advice Disclaimer

THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, OR FINANCIAL ADVICE. The content, including AI-generated suggestions, is for informational and motivational purposes only. Always seek the advice of qualified professionals with any questions you may have regarding health, mental health, or financial matters.

19. Export Controls

The App may be subject to export controls and economic sanctions laws. You agree to comply with all applicable export control and sanctions laws.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
